Statute of Limitations
Under Florida law, the deadline to file a medical malpractice lawsuit is called the statute of limitations. This deadline is generally two years from the:
- Date of the incident,
- Date the incident was discovered, or
- Date the incident should have been discovered with reasonable investigation.
There are exceptions to this law, so it is important to contact an attorney immediately if you believe you are the victim of medical malpractice. We can protect your legal rights.
Medical Malpractice Damage Caps
The money used to compensate you for medical bills, lost wages, and pain and suffering is referred to as “damages” in personal injury law. In Florida, there are limits—or caps—on the amount of damages you can recover in a medical malpractice case.
- Non-economic damages are limited to $1 million.
These damages are used to compensate you for pain and suffering, and do not provide compensation for your medical bills and lost wages.
- The ability to seek punitive damages is restricted to certain cases.
In order to seek punitive damages, which are intended to punish wrongdoing in an injury case, you must prove the medical provider intended to cause you serious harm.
At John Bales Attorneys, we can help you understand your rights to recover compensation in a medical malpractice case. We understand getting your life back after a medical malpractice injury is tough, and our medical malpractice lawyers are here to help. Contact us today.
